Schumer says Senate may vote to advance bipartisan invoice

The Senate could vote as soon as Wednesday to advance the bipartisan infrastructure bill, Majority Leader Chuck Schumer said.

“Senators continue to make good progress on both tracks of legislation,” the New York Democrat said, referencing both the physical infrastructure proposal and Democrats’ separate plan to invest $3.5 trillion in social programs.

Schumer’s comments signal progress toward a final agreement on infrastructure legislation after disputes over issues including transit funding prevented a deal for days. The wrangling threatened to derail a core piece of President Joe Biden’s agenda.

A spokesman for Sen. Rob Portman of Ohio, the lead Republican negotiating the deal, did not immediately respond to a request to comment on how close the lawmakers are to agreement.

The plan is expected to invest $579 billion in new money in transportation, broadband and utilities.

Schumer failed last week to start debate on the bipartisan plan. The Republican senators working on the bill with Democrats and the White House voted against advancing it as they tried to iron out disagreements.

The Democratic leader aims to pass the bipartisan plan and a budget resolution that would kickstart his party’s legislation before the Senate leaves Washington for its recess next month. Using budget reconciliation, Democrats can pass their bill without a Republican vote.

The bipartisan plan would need 60 votes to pass. It means at least 10 Republicans would have to back it if all Democrats sign off, or one more GOP senator would have to vote for it for every Democratic defection.

The vote to advance the bill would start a heavy lift for Democratic congressional leaders. They have to keep disparate wings of their party on board with both plans while navigating efforts by some Republicans to sink them.

House Speaker Nancy Pelosi, D-Calif., has stressed she will not take up either measure until the Senate passes both of them.

Democrats’ $3.5 trillion plan is expected to invest in child care, education, health care and efforts to curb climate change.

Schumer to push infrastructure invoice, finances decision this week

Senate Majority Leader Chuck Schumer, DN.Y., plans to proceed with the Senate passing a bipartisan infrastructure bill worth $ 1.2 trillion this week, despite the lack of consensus among the Senators negotiating the legislation about what will be in there.

Again this week, Schumer wants the Senate Democrats to agree to a $ 3.5 trillion budget dissolution, which they want to pass without a Republican vote.

Schumer is under heavy pressure to advance both of President Joe Biden’s domestic spending packages before Senators leave Washington early next month for a scheduled August break.

But several Republicans, whose votes Schumer must exceed 60 to move the infrastructure bill forward, have sounded the alarm over the hasty schedule and threatened to vote against efforts to postpone the bill before negotiators have finalized it.

“We shouldn’t have an arbitrary Wednesday deadline,” said Ohio Senator Rob Portman, the leading Republican negotiating the deal, on CNN’s State of the Union on Sunday. “We should come up with the legislation when it’s ready.”

However, Schumer sees the deadline as a crucial lever to force the bipartisan group of 22 senators to come to an agreement on difficult issues.

None are harder than paying for the $ 579 billion in new infrastructure they were planning to spend earlier this year.

Portman said he spent the past weekend working on the deal with members of the Senate group and the White House.

But rather than adding to the list of potential sources of funding for the bill, Portman said Republicans had recently removed a provision that would fund part of the infrastructure upgrade by collecting unpaid taxes.

“Everyone had productive talks, and it is important to keep the two-pronged process going,” said Schumer in the Senate on Thursday.

“All parties involved in the bipartisan talks on the Infrastructure Act must now finalize their agreement so the Senate can begin examining this bill next week,” he said.

Schumer announced that he will file a motion on Monday to proceed with a Shell bill to be used as a “vehicle” for the infrastructure bill once it is drafted. The Shell Bill contains a permit to finance highways that has already been passed by the House of Representatives.

This would initiate a further process vote on Wednesday. If 60 senators vote in favor of the Cloture appeal, Schumer’s office says it triggers up to 30 hours of debate in the Senate, followed by a vote on the motion to continue the Shell legislation.

During the subsequent amendment process, Schumer would file an amendment that swapped the Shell Act for the actual text of the final bipartisan infrastructure bill.

Aside from this week’s scheduled vote, the other major test that lies ahead of us for the infrastructure package is what is known as the bipartisan Congressional Budget Office’s bill, an estimate of how much the package would add to the federal deficit based on how much the proposed one Funding would actually pay.

Schumer has also set an ambitious deadline for his group on Wednesday to reach an internal agreement to move forward with their massive budget dissolution, including instructions on reconciliation.

If they could invoke this parliamentary maneuver, the Democrats could pass the $ 3.5 trillion budget with just a simple Senate majority – 50:50 50:50 with the Republicans – instead of the 60 votes that the GOP could require through the filibuster rules.

But the timeline is also squeezed there. Senate Budget Committee Chairman Bernie Sanders, who will lead the process of drafting the bill, only approved the topline number last week.

The package will likely include money for a universal preschool, free community college, expanded health insurance, subsidized childcare, extended family and sick leave, new low-income housing, and nationwide green energy projects.

If passed the Democratic way, the bill would represent both the largest expansion of the social safety net in decades and one of Washington’s most comprehensive efforts to curb climate change and prepare the country for its effects.

Republicans, meanwhile, have resisted the prospect of pumping trillions of dollars more into the economy as inflation rises.

The Democratic budget decision was “totally inadequate for a country already suffering from dramatic inflation,” Senate minority leader Mitch McConnell, R-Ky., Said last week.

However, many of the provisions in Biden’s two expense accounts are popular with voters. The Democrats are relying on this public approval to get the bills through in the next few weeks and months.

The party’s election hopes in 2022 likely depend on whether Biden’s two-pronged agenda actually goes through and whether Biden can maintain public support for it through November next year.

Biden will be promoting the two bills, dubbed the “Build Back Better” agenda by the White House, on Monday in remarks on the economic recovery from the Covid pandemic.

The president has publicly tried to assert himself above the battle during the infrastructure negotiations.

“There may be some minor adjustments to the payouts and that will depend on what Congress wants to do,” Biden told reporters Wednesday afternoon after meeting with Senate Democrats on Capitol Hill. the White House. “I’m not sure what can happen, exactly how it’s paid for,” he added.

But privately, senators from both parties have been in almost constant communication with important White House envoys over the past few days.

Portman said he spoke to White House negotiators about details of the infrastructure bill on Saturday night. On Thursday, a group of Senators met with the White House team on Capitol Hill.

As the House of Representatives returns to Capitol Hill this week, Spokeswoman Nancy Pelosi, D-Calif., And her aides are working behind the scenes to avert potential problems the moderate Democrats face with the $ 3.5 trillion budget plan, Punchbowl News reported Monday morning .

Pelosi has proposed that the Senate pass both the infrastructure deal and the draft budget before adopting them in the House of Representatives.

“There will be no infrastructure bill unless the Senate passes a reconciliation bill,” Pelosi said last month.

In a Milestone, Schumer Will Suggest Federal Decriminalization of Marijuana

WASHINGTON — Senator Chuck Schumer of New York plans to propose legislation on Wednesday to decriminalize marijuana at the federal level, putting his weight as majority leader behind a growing movement to unwind the decades-old war on drugs.

The draft bill, called the Cannabis Administration and Opportunity Act, would remove marijuana from the Controlled Substances Act and begin regulating and taxing it, placing federal rules on a burgeoning industry that has faced years of uncertainty. Though states would still be allowed to set their own marijuana laws, businesses and individuals in states that have legalized its use would be free for the first time to sell and consume it without the risk of federal punishment.

The proposal would also try to make recompense to communities of color and the poor for damage from years of restrictive federal drug policy. It calls for immediately expunging nonviolent marijuana-related arrests and convictions from federal records and would earmark new tax revenue for restorative justice programs intended to lift up communities affected by “the failed federal prohibition of cannabis.”

The bill aims to “finally turn the page on this dark chapter in American history and begin righting these wrongs,” said Senator Cory Booker, Democrat of New Jersey, who wrote the bill with Mr. Schumer and Senator Ron Wyden, Democrat of Oregon and the chairman of the Finance Committee.

The legislation faces an uphill battle in the Senate, where Republicans are opposed, and it is unlikely to become law in the near future. President Biden has not endorsed it, and some moderate Democrats are likely to balk at the implications of decriminalizing a drug that has been policed and stigmatized for so long.

But in the arc of the public’s rapid reconsideration of marijuana laws, the presentation on Wednesday was a remarkable milestone for legalization proponents. The suggestion that the Senate’s top leader and the chairman of the powerful Finance Committee would sponsor major decriminalization legislation would have been fantastical in the not-too-distant past.

In a speech on April 20, the unofficial holiday for marijuana smokers, Mr. Schumer said he was trying to prod Washington off the sidelines of a debate in which much of the country was already engaged. Public opinion polling suggests that nearly 70 percent of Americans support legalizing marijuana. Thirty-seven states and the District of Columbia have legalized marijuana for medical use, and 18 states plus D.C. allow recreational use by adults.

Mr. Schumer has also made no secret that he believes Democrats stand to benefit politically from embracing the legalization push, particularly with young voters.

“Hopefully, the next time this unofficial holiday of 4/20 rolls around, our country will have made progress in addressing the massive overcriminalization of marijuana in a meaningful and comprehensive way,” he said in April.

The senators were expected to detail their plans later Wednesday morning at a news conference at the Capitol.

They are expected to propose empowering the Food and Drug Administration and the Alcohol and Tobacco Tax and Trade Bureau at the Treasury Department to begin regulating the production, distribution and sale of marijuana, removing the Drug Enforcement Administration from its current oversight role. Among other implications, the changes would allow marijuana companies already operating in states where it is legal to gain full access to the United States banking system.

The legislation would gradually institute a federal excise tax like the one on alcohol and tobacco sales, eventually as high as 25 percent for big businesses, allowing the federal government to benefit from sales that came close to $20 billion in 2020. The revenue would then be funneled back to communities most affected by federal drug policy and to fund expanded medical research into cannabis that is currently limited by its status as a controlled substance.

One provision, for instance, would establish a cannabis justice office at the Justice Department to help fund job training, legal aid and help with re-entry after incarceration. Another program would promote loans to small cannabis businesses owned by members of racially or economically marginalized groups to try to ensure that communities that suffered disproportionately under the war on drugs are not left out of the gold rush that has accompanied legalization.

But the bill would aim to make other, more direct attempts to compensate for the impacts of years of aggressive policing. In addition to expunging past arrests and convictions, it would entitle those who are currently serving sentences for nonviolent federal drug crime to a court hearing to reconsider their sentences. And if enacted, the federal government would no longer be able to discriminate against marijuana users seeking federal housing, food or health benefits.

The Democratic-led House passed similar legislation in December, with a handful of Republicans joining to vote in favor. The vote was the first and only time either chamber had endorsed the legalization of cannabis, but the bill died at the end of the last Congress. House leaders plan to pass an updated version in the coming months.

Passage through the Senate is likely to be more tricky. Mr. Schumer would need to assemble 60 votes, meaning he would need the support of at least 10 Republicans. Though libertarian-leaning Republicans have generally supported ending the prohibition of marijuana, party leaders are likely to oppose the Democrats’ plan, particularly with its emphasis on restorative justice and government intervention in the cannabis industry.

But opposition is not limited to Republicans. Mr. Schumer would have to persuade moderate Democrats who are uncomfortable with the implications of decriminalization to support it.

Mr. Biden supports decriminalizing marijuana and pulling back the war on drugs, but his views are generally more conservative than many Democrats’ and he has not endorsed Mr. Schumer’s proposal. His White House made headlines this spring for pushing out five staff members over their use of marijuana.

McConnell criticizes Pelosi, Schumer over bipartisan plan

A bipartisan infrastructure proposal by President Joe Biden and a group of senators has regained a foothold.

Even so, the Democrats’ plan to get it through Congress, along with a broader package to expand the social safety net and fight climate change, faces a well-known threat: Senate minority leader Mitch McConnell.

Biden’s proposal last week to veto the bipartisan framework unless lawmakers adopt other democratic priorities briefly threatened the deal. The president reassured some Republicans by making it clear that if passed alone, he would sign the bill. But McConnell insisted Monday that the Democratic leaders on Capitol Hill must also separate the two laws, increasing the risk that the deal could fail.

“The president has appropriately separated a potential bipartisan infrastructure bill from the massive, independent tax and spending plans that the Democrats want to pursue on a partisan basis,” the Kentucky Republican said in a statement. “Now I urge President Biden to engage Leader Schumer and Spokesman Pelosi and ensure that they follow his example.”

Biden’s statement “would be a hollow gesture” unless Senate Majority Leader Chuck Schumer, DN.Y., and House Speaker Nancy Pelosi, D-California, make the same commitment to the bipartisan plan without it Pass Democratic law, McConnell said.

The statement by McConnell, who vowed to fight Biden’s economic agenda, underscores the dangers Democrats face in trying to enforce their priorities. Pressure from McConnell could undo the party’s delicate strategy of keeping its liberal and centrist members on board for both bills.

Representatives from Schumer, Pelosi and the White House did not immediately respond to requests for comment.

In a tweet on Monday, Connecticut Democratic Senator Chris Murphy offered his opinion on McConnell’s testimony, saying that “the all-consuming motivation of the GOP leader is to keep everything from happening when the Democrats are in control” .

Some progressives have threatened to oppose the bipartisan plan because it is not doing enough to combat climate change. A handful of middle-class Democrats have expressed doubts that without the Republicans they could be passing trillions of dollars in new spending.

To make sure neither of the two plans fail, Pelosi said she would not accept either of the proposals in the House of Representatives until they both reach the Senate. Schumer plans to start voting on both measures next month.

It is unclear whether Schumer and Pelosi will stick to the strategy if it means they could lose GOP votes for the bipartisan plan. In the Senate split 50:50 according to parties, an infrastructure law needs at least 60 votes to overcome a filibuster.

On Monday, White House press secretary Jen Psaki said Biden had contacted Schumer and Pelosi about how to proceed.

The move would take 10 Republicans to back it, if all Democrats support it, and one more GOP vote for every Democratic defection. Eleven Republicans backed the bipartisan framework, and some of those lawmakers signaled they were still on board after Biden clarified his position.

“I was very happy to see the president clarify his remarks because it didn’t match everything we were told along the way,” Senator Rob Portman, R-Ohio, told ABC News on Sunday.

Biden will try to further show his commitment to the plan this week. He will travel to Wisconsin on Tuesday to discuss the potential benefits of the Infrastructure Bill.

The framework includes $ 579 billion in new spending on roads, bridges, railways, public transportation, electric vehicle systems, electricity, broadband and water.

Schumer says Senate Democrats will work on invoice in June

Senate Democrats plan to forge ahead with crafting a massive infrastructure package next month — regardless of whether Republicans get on board — as they push to pass a bill this summer.

Senators will be out of Washington next week for the Memorial Day holiday. When lawmakers return, Democrats aim to write an infrastructure plan that touches on everything from transportation to broadband, utilities and job training.

“As the President continues to discuss infrastructure legislation with Senate Republicans, the committees will hold hearings and continue their work on the Build Back Better agenda — with or without the support of Republican Senators,” Senate Majority Leader Chuck Schumer, D-N.Y., wrote in a letter to Democrats on Friday. “We must pass comprehensive jobs and infrastructure legislation this summer.”

President Joe Biden has worked with Senate Republicans to see if they can strike a bipartisan deal to revamp American infrastructure. After the latest back-and-forth in their talks, the sides appear far from an agreement on what should go into a bill and how the government should pay for it.

As the White House and Republicans struggle to reach a consensus, some Democrats have called on their party to try to pass a bill without GOP support. Democrats can do so through the budget reconciliation process, which requires a simple majority vote in the evenly split Senate.

Republicans on Thursday sent Biden a $928 billion infrastructure counteroffer. It came in at roughly half of the $1.7 trillion proposal the White House last sent the GOP. The Biden administration first put forward a $2.3 trillion infrastructure plan.

Responding to the offer, White House press secretary Jen Psaki praised “constructive” additions to road, bridge and rail spending. She said the White House “remains concerned” about Republicans’ proposed spending on modernizing railways and transitioning to clean energy, along with the party’s calls to pay for infrastructure with previously passed coronavirus relief funds.

The White House has said it expects nearly all of the aid money to be spent. Redirecting the funds could jeopardize support for small businesses and hospitals, Psaki said.

Despite the lingering differences, the sides expect to continue talks. Biden could meet again with Sen. Shelley Moore Capito, the West Virginia Republican leading negotiations with the White House, as soon as next week.

The parties will have to work through two huge disagreements to strike a deal. First, they have disparate visions of what counts as infrastructure.

The White House wants to include programs such as care for elderly and disabled Americans, which it calls vital for putting Americans back to work and boosting the economy. Republicans want to limit the legislation to areas including transportation, broadband and water.

Biden and Republicans could also struggle to find a compromise on how to pay for the infrastructure plan. The president wants to hike the corporate tax rate to at least 25% — and crack down on corporate tax avoidance overseas and individual tax underpayment at home — to offset the spending.

The GOP has said it will not support changes to its 2017 tax cuts as part of an infrastructure bill. The party slashed the corporate rate to 21% from 35%.

It is unclear how much longer talks will go on if Democrats and Republicans cannot strike a deal. On Thursday, Capito said Republicans “continue to negotiate in good faith.”

In his letter, Schumer noted that he was “encouraged” by the Senate Environment and Public Works Committee advancing a roughly $300 billion bipartisan surface transportation bill this week.

Senate Minority Leader Mitch McConnell, a Kentucky Republican who previously said he would work to fight Biden’s broader economic agenda, said Thursday that his party would continue to engage with the president.

“We’d like to get an outcome on a significant infrastructure package,” he told CNBC.

Democrats passed Biden’s first big-ticket bill, a $1.9 trillion coronavirus relief plan, without a Republican vote in March.

Schumer requires marijuana to be decriminalized by subsequent 12 months’s 420

Senate majority leader Chuck Schumer on Tuesday reiterated his call to legalize marijuana at the federal level, saying he hopes to end the drug ban by April 20 next year.

“Hopefully next time, when this unofficial holiday, April 20th, is over, our country will have made progress in a meaningful and comprehensive fight against the massive over-criminalization of marijuana,” said Schumer on the floor of the upper chamber.

Schumer said the nation’s war on drugs “too often has been a war against people, especially those of skin color”.

“I believe the time has come to end the federal marijuana ban in this country, and I’m working with Sens. Booker and Wyden on laws to do just that,” he said.

In February, Schumer and Sens. Cory Booker, DN.J., and Ron Wyden, D-Ore., Published a joint statement calling for restorative justice for people convicted of pot-related crimes.

Senators then said they would release “a single draft discussion on major reforms” earlier this year and that passing the law would be a priority for the Senate. The draft has yet to be published.

The House recently passed law allowing banks to work with cannabis companies in states where cannabis is legal. This was seen as a move to allow more commercial use by the federal government.

This legislation is now awaiting Senate approval.

To date, 15 states and the District of Columbia have legalized marijuana for recreational adult use, and 36 states allow the drug to be used medicinally.

New York enterprise leaders push Biden, Schumer to take away cap on SALT deductions

Financial leaders and other corporate leaders in New York are urging President Joe Biden and Senate Majority Leader Chuck Schumer, who represents the state, to bring back full state and local tax withholding, according to people familiar with the matter.

Schumer, who is eligible for re-election in 2022, has heard on multiple calls from business executives across New York in the past few weeks, these people added. Some of these people have also had conversations with Biden advisors.

Schumer, these people noted, only announced Friday that he plans to secure repayment of the full deduction when negotiations begin on reforming tax law to fund Biden’s next initiatives, including rebuilding national infrastructure.

Some of these people declined to be identified in order to speak freely about the conversations.

Schumer himself tried to bring the trigger back. Schumer and his Democratic New York Senator Kirsten Gillibrand tabled a bill in January to lift the SALT cap.

“Senator Schumer has long been a supporter of the SALT deduction and has spoken out vehemently against the punitive Trump tax legislation that has severely undermined him. He is looking for the best way to lift the SALT deduction cap,” said a Schumer spokesman .

The so-called SALT deduction was limited to US $ 10,000 by former President Donald Trump’s tax reform law, which came into effect in late 2017. Taxpayers, particularly wealthy people, in New York and other high-tax countries, including New Jersey and California, saw the greatest benefit when there was no cap. SALT deductions take into account state and local taxes, including property and income taxes.

The cap, the Tax Foundation said, “broadened the tax base by capping the amount that individuals could deduct from state and local taxes to $ 10,000. For high-income taxpayers, that cap increased federal taxable income.”

Tracy Maitland, president of investment advisory firm Advent Capital Management, told CNBC in an interview Monday that he is one of the business leaders who worked with Schumer and other lawmakers to bring back the SALT trigger.

Without the full deduction, Maitland said, New York City in particular will continue to enjoy great financial success. The New York Department of Labor said the state lost 1 million jobs last year at the height of the coronavirus pandemic.

“It is important that New York remains a viable community. It is a financial capital of the world. If New York becomes less financial capital, I believe it will affect not just the city but the nation in general,” Maitland said. He later pointed out that some in the financial industry are moving to states like Florida to pay less taxes.

Kathryn Wylde, president and CEO of the New York City partnership, with hundreds of members representing businesses across the city, told CNBC that Schumer raised the need to use the SALT trigger during a virtual fundraiser Friday for his re-election offer bring back.

According to Wylde, Schumer told attendees that he plans to push for the return of the SALT deduction in the upcoming round of negotiations, which will likely focus in part on the payment methods for Biden’s infrastructure proposal.

“I had a call with him Friday and he clearly said that he couldn’t handle it in the last bill ($ 1.9 trillion Covid stimulus) because there was no tax, but the next one it will definitely be its a top priority for him, “said Wylde. “He made it clear that this is a top priority,” she added, explaining that many members of her group had contacted Schumer and Biden’s team to bring back the full SALT trigger.

Wylde says in her conversations with Biden consultants that they are “sympathetic” to calling to bring the full trigger back. People in the president’s orbit suggested that the reason Trump restricted SALT in the first place was because of “punishing the blue states,” she said.

The partnership’s executive committee includes JPMorgan CEO Jamie Dimon, BlackRock CEO Larry Fink, Citigroup CEO Jane Fraser and Blackstone CEO Steve Schwarzman.

Biden will speak to Congress about how to pay for his infrastructure plan after unveiling it in Pittsburgh on Wednesday, White House press secretary Jen Psaki said Monday.

Biden has said he wants to raise taxes for those who earn more than $ 400,000 and raise the corporate tax rate from 21% to 28%. As president, he still has to discuss where he is on the SALT cap.

Several reports indicate that Biden’s administration plans to use tax increases to pay for the president’s infrastructure plan, which is expected to cost at least $ 2 trillion.

A White House representative did not return a request for comment.

Cuomo has denied Boylan’s allegations. He was charged with sexual harassment by several women, leading Democrats across the state to demand his resignation. A majority of the New York delegation in the House of Representatives called on Cuomo to step down on Friday.

Both New York Senators Supported the New York District Attorney’s general investigation into Cuomo’s alleged conduct, but not requested to resign.

Cuomo has denied all allegations of harassment and stated on Friday that he will not resign.

Although the Cook Political Report identifies Schumer’s race as a “solid Democrat,” an outside political action committee could complicate his race and recruit other candidates for Schumer in a democratic elementary school.

Gillibrand previously called for the then Democratic Senator Al Franken to resign when he was accused of sexual misconduct.
